Summary:
The purpose of the Kress Dealer Internet and E-commerce Policy is to provide
guidance to Kress Dealers on Dealers’ internet and social media activities related
to the Kress brand and Kress products. This Policy and Procedures document is
incorporated in the Kress Dealer Sales and Service Agreement (the “DSSA”). Any
conflict between this Internet and E-commerce Policy and the DSSA is to be
resolved in favor of the DSSA.
Policies and Procedures
1. Inclusion of Kress on Dealer Website(s). The Company encourages each Dealer
to include Kress Products on their website. Dealer must adhere to advertising
the retail price set by Kress for consignment products considered new and
within their warranty period. Kress dealers may advertise and promote new
Kress products only on the website of the entity that signed the DSSA with
Positec.
2. Dealer Online sale of Kress Products. Although Customers may order Kress
Products online, all Kress Products must be sold and delivered in person by
authorized Kress Dealers. Dealers are responsible for set-up and delivery of
Kress products and training of retail Customer(s).
3. E-commerce Platforms. All Kress dealers are prohibited from selling any Kress
products that are considered new and within their warranty period on thirdparty e-commerce platforms, including but not limited to Tractorhouse,
Amazon, Walmart, Shopify, Ebay, etc.
4. Online Advertising and Social Media. The Company encourages Dealers to
actively participate in online advertising and social media activities, provided
that the online activities do not directly result in an e-commerce transaction
outside of a solution provided by the Company.
5. Kress Logo, Marketing Materials, and Templates Usage. Positec Commercial,
Inc. will provide access to digital versions of Kress logos, marketing materials,
and templates. No changes should be made to the materials provided without
prior approval.
6. Policy Violation Process. If a violation of this policy occurs, the Dealer will be
notified that they are in violation of the Internet and E-commerce Policy and will
have 24 hours to become compliant. Upon notice of second violation, the
Dealer is subject to all penalties that Positec Commercial, Inc. may deem
appropriate, including loss of incentive programs or Dealer termination.
