Summary:
The purpose of this Kress Dealer Branding and Advertising Policy is to provide
Dealers guidance related to the Kress trademark usage and advertising guidelines
as it relates to Kress products and being a Kress-approved Dealer. This Policy and
Procedures document is incorporated in the Kress Dealer Sales and Service
Agreement (the “DSSA”).
Policies and Procedures
1. Tr ademark s and Mark eting Mater ials. Only approved Dealers have
permission to use pr oprietary marketing materials in adver tising.
a) Logos and reg istered trademark information must be published in the
same color, font, and format as provided to Dealers in the Kr ess
Dealer Portal.
b) When applicable, registratio n marks are requir ed.
c) Product images and photos may be used but not modified without
prior written approval.
d) Dealers do not have any owner ship rights to proprietary infor mation.
e) Dealers are responsible for maintaining accur ate and current data on
all Dealer-owned websites and printed marketing materials, including
but not limited to social med ia p latforms.
f) Upon termination of a Kress Dealer relationship, all use and r eference
to marketing mater ials must immediately cease alo ng with any
representatio ns of being a Kr ess Dealer.
2. Kress Point of S ale Mater ials and Merchand isers. Dealers will be provided
various point-of-sale marketing mater ials, includ ing but not limited to signs,
banners, catalogs, and clothing with the expectation that the items will be
displayed and utilized by the Dealer to pr omote Kress products to
Customers inside and outside of approved store locations. Those mater ials
may be shipped dir ectly to Dealers or deliver ed in person by the Company
or third-party affiliates. Upon receiving materials, Dealers ar e expected to
review them for any potential missing components or shipping damage.
Dealers w ill receive assistance from the Kress sales team to install and
place merchandisers and marketing materials.
